Day Sail Terms & Conditions

In signing this form you agree to accept a place on a day sail under the conditions set out below. This contract is governed by English law, and is subject to the exclusive jurisdiction of the English courts with regard to any claim, dispute or other matter arising in connection with the contract.

Adventure Under Sail Ltd (hereinafter to be referred to as ‘AUSL') cannot under any circumstances accept any person who is pregnant, or is a carrier of a serious communicable disease (e.g. Hepatitis B, Hepatitis C & HIV). Disabled persons will be considered on an individual basis.

AUSL reserves the right to refuse any booking for any reason which in its opinion might affect or endanger the safety of T.S. PELICAN and or any person or persons onboard.

Adventure Under Sail Ltd undertake to:

• Ensure that the vessel will be under the command of a suitably qualified individual, supported by the require professional crew.
• Ensure that all fire-fighting, lifesaving and safety equipment on board T.S. PELICAN conforms to statutory requirements.
• In good time, the date, time and place for embarking and disembarking the Pelican of London will be sent to voyage crew.
• AUSL reserves the right to cancel a voyage for any reason beyond its control, including, but not limited to bad weather, which may endanger the safety of the vessel and crew.  AUSL will issue a refund but otherwise accept no liability whatsoever.

As a Passenger I undertake to:

• Meet the cost of my own travel to and from T.S. PELICAN.
• Declare any problems or medical conditions  I may have at time of booking.
• I will notify any change in my personal medical condition between booking and the day sail, in writing.

Payment Terms

• Payment should be sent with the booking form.
• Cheques made payable to ‘Adventure Under Sail Ltd.'

Liability

Sailing can be a particularly dangerous activity in rough weather which may be encountered at any time during the day sail. AUSL shall not be liable for any damage, loss or injury consequential, direct, economic or indirect, arising out of, or in connection with the specified day sail. The master and permanent crew of T.S. PELICAN shall have no responsibility for failure of the vessel to complete the voyage or scheduled programme, due to bad weather, mechanical breakdown whilst at sea or for any other reason beyond the control of AUSL or any other person for whom AUSL is legally responsible.

AUSL may cancel a day sail up to two weeks before its departure date, if bookings are less than 50%. They may also cancel up to 24 hours before the day sail if the weather is deemed unsuitable. If cancellation is by AUSL, you will be offered an alternative AUSL day sail.  AUSL shall not be liable for any other sum by way of compensation.
